The described Hotel Packages are hosted by Victoria Hendree, Agent ID #98526 Florida Registration #35395, and CST #2001330-10. All transactions are handled by Hendree Travel/Victoria Hendree.
This agreement is between Victoria Hendree; doing business as (DBA) Hendree Travel; which is a service provider for Victoria Hendree and the Travel Client(s) listed above. This contract will be deemed legally binding once the Terms and Conditions have been accepted.
There is a nonrefundable/nontransferable retainer fee due before any quotes/research is done.
I acknowledge ALL DEPOSITS AND PAYMENTS ARE NON-REFUNDABLE/ NON-TRANSFERABLE. Changes to the reservation are subject to availability, the hotel policies and/or rules. There will be a $75 change fee for every occurrence and must be paid prior to the change.
I acknowledge there will be a $50.00 Service Fee applied to ALL ACCOUNTS that do not meet the monthly fees schedule. This fee will be applied at each occurrence--NO EXCEPTIONS.
I acknowledge payment must be made in FULL in order for the Room Assignment to be confirmed.
I acknowledge failure to make payments will result in all monies being forfeited.
Hotel Policies: The hotel is a non-smoking facility. Contact the hotel directly to review all of their policies including parking and available amenities. Porterage, Parking, and/or Breakfast are not included with the reservation--except where indicated on the Registration Form. Guests may inquire with the hotel directly for cost and availability of these amenities and/or services.
Client preference of Bed type shall be remitted to the hotel. The hotel will make its best efforts to accommodate all preferences but shall be at their discretion.
Attorney’s Fees: The said parties agree that in the event that a dispute arises relating to this contract, the prevailing party in any arbitration or court proceeding will be entitled to recover an award of its reasonable attorney, expert witness fees, cost and pre- and/or post-judgment interest.
Liability: Service Provider and Travel Agent do not accept any liability of any nature, whether in contract or out of this contract, or otherwise for the acts, omissions or default, whether negligent or otherwise, of these service providers, over whom we have no direct or indirect control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased Hotel Accommodation stay which would be sought from the Travel Agent of record, Victoria Hendree of Hendree Travel. Service Provider and Travel Agent are not liable for any consequential loss or damage and do not accept any liability in contract, tort or otherwise for any injury, damage, loss of life or limb, delay, additional expense or inconvenience caused directly or indirectly by force of nature or any other event which is beyond our control or which is not preventable by reasonable diligence on their part.
Waiver of Right to Chargeback: Client(s) waive any right to charge-back or disputes of payments willfully made by the clients to Hendree Travel; or VIctoria Hendree or any other agent(s) representing the same. If the client initiates a charge-back or dispute, client agrees to pay the Service Provider or the Travel Agent (to whom said charge-back or dispute is initiated again) at a fee of $100 plus any legal fees, attorney fees, the outstanding balance of the invoice, any overdraft fees and penalties rendered by banking institutions, and/or all other relief provided for by the law.
Cancellation by the Client: Any cancellation by the client must be delivered to the Service Provider and the Travel Agent in writing. All payments are non-refundable and will be forfeited by the client immediately upon cancellation, unless stated otherwise.
It is recommended that the client purchase Trip Cancellation Coverage, or what is referred to as travel insurance. Trip Cancellation insurance is the only means of receiving reimbursement for the non-refundable expenses should the client cancel their trip for any reason, whether voluntary or as the result of travel agent, hotel or service provider’s actions.
Refusal of Service: Travel Agent and Service Provider have the right to refuse service to any client at any time for any lawful reason whatsoever; it shall be at their sole discretion.
Effective Date of Communications: This contract, upon signature/acceptance by all parties, constitutes the entire agreement between the parties and may not be amended or changed unless done so in writing and signed by the client(s), Victoria Hendree of Hendree Travel and their representatives. The undersigned expressly agree and warrant that they are authorized to sign and enter into this contract on behalf of the event, party, product, and/or service that is, was, or will be provided for which they sign.
Payment Plans: A Full monthly payment must be made by the end of each month. Please note the payments can be split into two payments if needed. NO EXCEPTIONS! A $50.00 late fee will be assessed, if payments are more than 5 days late. If the payment falls to being thirty (30) days past due, the Reservation will be Cancelled and all monies will be forfeited--NO EXCEPTIONS.
Hendree Travel has the right to amend the terms and conditions whenever deemed necessary.

ASSUMED RISK/HOLD HARMLESS STATEMENT
Travel has its own inherent risks, and the traveler acknowledges such risks exist, up to and including death. Hendree Travel will take all reasonable precautions to insure the health and safety of the traveler. The traveler agrees to hold Hendree Travel, its employees and agents harmless should illness, accident or death occur. Hendree Travel is not responsible for the actions, expenses or harm incurred by travelers who disregard the instructions of the Hendree Travel representative(s), travelers who depart from the planned activities of the tour, or travelers who follow the instructions of a non-Hendree Travel representative(s).
Hendree Travel is not responsible for time changes made by the airlines, bus conductor and railways. Flight times and seat assignments are solely at the discretion of the airlines. Hotel room location is the sole discretion of the hotel. Requests can be made but are not guaranteed. Baggage fees of the airlines are not included in group trip prices. If you decide to check baggage you must pay this fee directly to the airline. The carriers, accommodations and other suppliers providing services are independent contractors and are not agents, employees of Hendree Travel. Hendree Travel assumes no responsibility and will not be held liable for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity by reason of (1) any wrongful or negligent acts or omissions on the part of its suppliers, (2) any wrongful, negligent, or unauthorized acts or omissions on the part of any employee of these suppliers, (3) any defect in or failure of any vehicle, equipment or instrumentality owned, operated, or used by any of these suppliers, or (4) any wrongful or negligent acts or omissions on the part of any other party not under the control, direct or otherwise, of Hendree Travel, or (5) acts of God.
The traveler agrees for him/herself, his/her heirs and assigns, executors and administrators to hold harmless and release Hendree Travel, or any other sponsoring organization(s) and/or subsidiaries, affiliates, officers, representatives or successors (released parties”) from any and all losses, causes of action, liabilities, indirectly from participation in connection with hosted group trips and/or the condition of the property, facilities or equipment used for hosted group trips, regardless of when, where or how such claim may arise and regardless of whether caused by the disappearance of negligence of the Released Parties or otherwise, including, without limitation. Claims relating to (i) any theft, loss or disappearance of property, (ii) bodily injury (fatal or non-fatal) and (iii) property damage.
"Force Majeure. Neither Party will be held liable for failure to fulfill its obligations hereunder if such failure is due to a Force Majeure Event. A “Force Majeure Event” means, but is not limited to, an act of war; domestic and/or international terrorism; civil riots or rebellions; quarantines, embargoes and other similar unusual governmental actions; or extraordinary elements of nature or acts of God; provided that such Force Majeure Event is beyond the excused Party’s reasonable control, occurs without the excused Party’s fault or negligence, is not caused directly or indirectly by the excused Party and could not have been prevented or avoided by the excused Party’s reasonable diligence.
Covid-19 Waiver of Liability
In Spring 2020, the World Health Organization (WHO) declared that the Novel Coronavirus (COVID-19) a worldwide pandemic. If contracted, this virus has the ability to cause the traveler extreme illness, including, but not limited to, death. I understand that I am taking the risk of traveling with the knowledge that of the effects of contracting COVID-19.
